"Neighbor needs to drive over my property to get his camper in and out of his property."

I've been in this house for four years and my neighbor on one side has been here since the neighborhood was first built in the 80s.

He has this large RV that he stores in his side yard. A previous owner of my house and my neighbor paved over the space between our driveways to make one massive connected driveway, so that he could get his RV out of his side yard.

Down the middle of this mega driveway is a curb that is on his side but marks the property line.
  • 05
In order to get his RV out of his driveway, he has to drive over the curb and into my property.
  • 06
There is no way for him to get his RV in and out without driving on my property, since it is a tight fit.
  • 07
He actually spends on average 30 minutes moving it forward and backwards to get the angle just right to fit, which means he is driving over that curb, back and forth, at least a dozen times each time he moves it.
  • 08
A few problems with this: 1. He never asked me if this was okay when we first moved in.
  • 09
He just told me this is what he was doing and that he had agreement with a previous owner.

Being a first time home owner, I was trying to keep the peace and establish a good relationship but didn't realize how often it would be.

    2. Every time he needs to move it, he has to come over to ask me to move my car so he has room.
  • 12
My car is always parked on my original driveway, not the extension, so he really has to drive 10-15 ft into my driveway each time in order to get it out.
  • 13
I WFH and he has spammed my doorbell before while I was in calls because he wanted me to move my car.

a person pressing the doorbell button at the front door of a home

I personally hate having to move my car off my property so someone else can use access my property.
  • 16
There is never a convenient time for this, he is retired and wants to use it often.
  • 17
    3. The concrete on my property, right where he has to drive over his curb is cracking a lot.
  • 18
I have noticed it is getting worse each year I've been living here. It is absolutely related to moving a F250 + a RV over it.
  • 19
My wife and I hate the mega driveway. It serves no purpose to us. We think it is an eyesore to have that much concrete spanning the front of our property.
  • 20
We also love gardening and have talked about getting rid of our side of the concrete and turning it into more garden space, we would love to plant a tree there.
  • 21
But at the same time, things are cordial and I don't want to make an enemy out of a neighbor.
  • 22
It just feels like we are going to reach a point where the driveway is broken enough that something needs to be done.
  • 23
I also don't know if he has any legal rights to use this part of my property, since he has been using it for years before we purchased the home.
  • 24
There was no easement agreement between him and the previous owner(s), that I know of. The last time he asked me to move it I expressed my concerns above and said I don't see this continuing to work as is.

Any advice or insights is helpful.
